Welcome to Tommy's Aquatics. By accessing our website or placing an order, you agree to be bound by these Terms of Service. Please read them carefully before purchasing.

1. About Us

Tommy's Aquatics is an Australian online retailer specialising in quality home-bred freshwater aquarium livestock and aquarium-related products.

Throughout these Terms, "we", "us", and "our" refer to Tommy's Aquatics. "You" refers to the customer or website user.

2. Eligibility

By placing an order you confirm that:

  • You are at least 18 years of age or have permission from a parent or legal guardian.

  • The livestock you purchase is legal to own in your state or territory.

  • You understand the care requirements of the livestock you purchase.

It is your responsibility to ensure you comply with all local laws regarding the ownership and transport of aquarium livestock.

3. Product Information

We strive to provide accurate descriptions and photographs of all livestock.

Please note:

  • Colours may vary due to lighting, age, diet and genetics.

  • Size measurements are approximate.

  • As all livestock are living animals, every specimen is unique.

Images are intended as a guide only.

4. Pricing

All prices are displayed in Australian Dollars (AUD).

Prices may change without notice.

Orders will be charged at the price displayed at the time the order is placed.

5. Payment

We accept payment methods offered through Shopify.

Orders are not confirmed until payment has been successfully received.

We reserve the right to cancel any order where payment cannot be verified.

6. Shipping

We carefully package all livestock to maximise survival during transport.

Shipping times may vary depending on your location and courier performance.

Once an order has been collected by the courier, delivery times are outside our control.

We are not responsible for delays caused by:

  • Courier disruptions

  • Weather events

  • Natural disasters

  • Public holidays

  • Incorrect delivery details supplied by the customer

7. Live Arrival (DOA) Guarantee

We offer a Dead on Arrival (DOA) guarantee subject to the following conditions:

To make a DOA claim you must:

  • Contact us within 2 hours of the delivery being marked as delivered.

  • Provide clear photographs of the unopened shipping bag showing the deceased livestock.

  • Provide photographs of the shipping box and shipping label.

Claims submitted outside this timeframe may not be accepted.

DOA claims will not be approved where:

  • Incorrect shipping information was supplied.

  • Someone was unavailable to receive the parcel.

  • The parcel was redirected.

  • The parcel was left unattended after delivery.

  • The customer requested delayed shipping.

  • Extreme weather conditions occurred outside our control.

Approved claims may be refunded, credited or replaced at our discretion.

Shipping charges are generally non-refundable.

8. Customer Responsibilities

You are responsible for ensuring:

  • Your aquarium is fully cycled.

  • Water parameters are suitable for the livestock ordered.

  • Livestock are acclimated correctly.

  • Suitable tank mates are provided.

  • Appropriate ongoing care is maintained.

We cannot be held responsible for livestock losses resulting from unsuitable aquarium conditions or incorrect husbandry.

9. Order Cancellations

Orders may be cancelled prior to dispatch.

If an order has already been packed or shipped, cancellation may not be possible.

Refunds for cancelled orders may exclude transaction fees where applicable.

10. Returns

Due to the nature of live animals, we do not accept returns of live livestock except where required under Australian Consumer Law.

Non-livestock items may be eligible for return subject to their condition.

Please contact us before returning any item.

11. Livestock Availability

As our livestock is home-bred and stock levels change regularly, availability cannot always be guaranteed.

If an item becomes unavailable after purchase, we may:

  • issue a refund;

  • provide store credit; or

  • offer a suitable replacement with your approval.

12. Website Use

You agree not to:

  • misuse the website;

  • interfere with website security;

  • upload malicious software;

  • attempt unauthorised access to our systems.

We reserve the right to refuse service where these Terms are breached.

13. Limitation of Liability

To the maximum extent permitted by Australian law, Tommy's Aquatics shall not be liable for any indirect, incidental or consequential loss arising from:

  • delays in shipping;

  • courier handling;

  • livestock losses after successful delivery;

  • incorrect care by the customer;

  • equipment failure within the customer's aquarium.

Nothing in these Terms excludes rights provided under the Australian Consumer Law.

14. Australian Consumer Law

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.

Nothing in these Terms limits or replaces your statutory rights.

15. Privacy

Any personal information collected through our website is handled in accordance with our Privacy Policy.

We do not sell customer information to third parties.

16. Changes to These Terms

We reserve the right to update these Terms of Service at any time.

Changes become effective immediately upon publication on this website.
